Official Contest Rules
1. General Provisions
MOO, Inc. (“MOO”) is happy to sponsor ‘The Business Card Project’ (the “Contest”). Entry into the Contest is strictly free and no purchase or other form of indirect payment is required. The Contest is open to all legal residents of the United States and the District of Columbia and of the United Kingdom and worldwide but shall be void in Puerto Rico and wherever prohibited or restricted by law. Entrants must be at least 18 years or older as of June 23, 2010. The Contest is not open to employees of MOO or their immediate families and household members or MOO’s affiliates, participating vendors, distributors, advertising and promotion agencies (collectively, the “Contest Entities”). The Contest is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Contest, entrants agree to accept and be bound by all terms of these Rules. All entrants from countries outside the jurisdiction of U.S. law should check that entry into this Contest is lawful under the laws of their own countries or territories and MOO shall have no liability or responsibility to any entrant who, by entering, has failed to comply with the legal requirements in regard to contests or competitions in their own countries or territories.
2. How to Enter
The Contest will be open from June 23, 2010 through August 31, 2010 (the “Promotional Period”). To enter the Contest, participants must log on to the website, located at http://www.businesscardproject.com and complete an entry form providing certain information about the participant. All entry forms submitted during the Promotional Period will be considered an entry and eligible for the Contest (each, an “Entry”). To be eligible, all Entries must be sent no later than 11:59 p.m. (ET) on the last day of the Promotional Period.
Upon submission, each Entry will automatically become the property of MOO. MOO will not use the entry other than for the purposes of the Contest and any marketing and promotion of the winners (and winning submissions) as described below. MOO is not required to provide copies of any entry. If you wish to have a copy of your submission, please retain a copy.
MOO is not responsible for misdirected, incomplete, lost, or late Entries, technical, hardware, or software failures, whether human, mechanical, typographical, electronic or otherwise, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Contest. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor’s control, which corrupt the integrity, administration, security or proper operation of the Contest, MOO reserves the right, in its sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, MOO reserves the right to award prizes from among all eligible, non-suspect Entries received prior to the event requiring such cancellation.
3. How to Win
Five hundred (500) winners will be chosen by a committee consisting of members from MOO’s Marketing and Design departments and of an independent judge (whose name shall be made available upon request) from all eligible and completed Entries received by the entry deadline. Winners will be chosen based on the committee’s assessment of the entrant’s existing business card and MOO’s ability to improve upon the business card, as well as the entrant’s essay concerning the redesign of their cards. The decision of the committee will be final and binding. The winners will be notified by e-mail on or before August 31, 2010. Odds of winning depend on the number of eligible Entries received.
4. Prizes
The following prizes will be awarded:
Description of prize: One-time redesign service (up three design reviews and a maximum of 10 design hours), completed PDF and InDesign files ($475) & 50 Business Cards from MOO, Inc. (www.moo.com)
Approximate Retail Value of Each Prize: $500
No substitution or transfer of prizes or cash redemptions is permitted by the winners. MOO reserves the right to substitute any prize(s) of like value for any reason whatsoever. Winners are responsible for the reporting and payment of all taxes (if any).
Each Prize is provided to the applicable winner “as is” and “with all faults.” MOO does not provide any guarantee concerning the winner’s satisfaction with their Prize. The Prize is provided “as is” and “with all faults.” MOO hereby disclaims all warranties of any kind with respect to each Prize, whether express, implied, statutory or otherwise, including the warranties of merchantability, fitness for a particular use or purpose and non-infringement. To the extent such disclaimer conflicts with applicable law, the scope and duration of any applicable warranty will be the minimum permitted under such law.
5. Publicity and Other Terms
By claiming the prize, each winner hereby authorizes the use, without additional compensation, of his or her name, likeness, voice, and/or photograph, as well as the reproduction and distribution of the winner’s written submission, original business card and the redesigned business card for MOO’s own promotion and/or advertising purposes in any manner and in any medium (including without limitation, radio broadcasts, newspapers and other publications as determined by MOO in its discretion distribution over the internet and otherwise). Each winner may be required to sign, without limitation, an affidavit of eligibility, a name/likeness release as well as a liability release, and a tax acknowledgment form. Such documents would need to be returned to MOO within ten (10) days of the issuance of the notification from MOO. If MOO does not receive a response within that time period, then the entrant may be disqualified.
6. Alternate Winners; Disclaimer
If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize or (iii) a potential Winner fails to comply with any of the Rules as outlined herein, such potential Winner will be disqualified and an alternate winner will be determined at MOO’s sole discretion. The Contest Entities expressly disclaim any responsibility and entrants agree to indemnify and hold harmless the Contest Entities and their respective employees, officers, directors, shareholders and agents, from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from among all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Rules. No more than the stated number of prizes per these Rules will be awarded.
